^ I don't think we agree on one point. I'm saying there is nothing ambigous about their wording that leaves the door open. They say if you want the HW design, contact us and we may give you permission. There is no ambiguity there, and if it went to court , no lawyer under the sun could argue that the statement gives them the right to rebrand and sell Ouya's - and win . I know Ouya has left the door open on some occasions, like with the Free the Games Fund or Open source comments, but IMO, this isn't one of those cases. For the sake of not starting an argument and wrecking this thread, I think we will have to agree to disagree and move on regarding this point.
As for it being sold as a modified Ouya, I don't know if Ouya cover this on their site, if not, it would come down to the Copyright etc laws in the US . Perhaps if they don't cover it on their site, they should as you suggest. and not just leave it to be covered by the Copyright laws - if it is covered at all. Probably not covered actually, at least I cant see anything legally wrong with re selling Ouyas as long as they are not rebranded and bought from Ouya and not directly from the chinese manufacturer. Might be rules and limitations on this though , don't know.
