However, the point is, OUYA has muddied the waters here yet again with talk of "open" and being "hackable". The kickstarter not only mentions mods and peripheral creation, it outright says "we'll give you the hardware design". This depends on how "give" is interpreted. It could be interpreted as a good faith kind of thing with an implied license.
Whatever recourse OUYA takes ends up being another black eye in some way. They'll be the evil corp who's picking on the little guy. Or that they somehow "lied" again based on a vague set of rules and guidelines.
