Luckily there is a method that will tell wether or not it was overclocked that is done withing 1-3 minutes, let me put my old post here:

Remember; These are dev kits, so any figures you get shouldn't be taken as an indication of the consumer release OUYA because there'll be software tweaks and other things going between now and the time those are released.

Updated Information: A Member of the Ouya Team just confirmed it is a Tegra 3 T33, the fastest model available!

Well Ouya is completely new in the market offering a damn cheap console.
Would they risk overclocking without Nvidias advice or reliable long term data from other devices? I do not think so.
If they get a lot of dead consoles back they need to replace they are history.
I personally think that Nvidia will tell them a maximum temperature limit which allows them to get around 10-20% more clock speed with a good cooler.
But there will probably not be any to the limit overclocking as we can hear it from individual people who risk damaging their hardware (Nexus 7 reports etc).
