The difference between SPMC and XBMC

I have a question. If OUYA doesn't have the license to use it then how does Koying have it for SPMC? Is it a license that allows for non-commercial use and a royalty if used for profit or something?

I wish I had an answer for you but I'm about as clueless as you are. Maybe someone else can answer it for us.
