Who to say some off the early adopter Developers don't already have a early prototype to work with.
I am pretty sure Square Enix got their Ouya long before a non-backer Developer did.
And even if they didn't get a official Ouya before everyone else they cal always installed the Ouya os to another android device like the Nexus 7 for early testing.
