I don't blame the developer for trying to use a loophole while in a desperate situation but I do blame them for trying to point fingers at Ouya when it didn't work out. Can you blame Ouya for not saying "Yes, please take advantage of our loophole and take our $50,000 for a project that will likely not help Ouya in any way". They were honest about it at least and that honesty may have led to the recent changes in the program. I think it's a better outcome for the dev to be rejected by Ouya before the project closed instead of waiting to find out later that they aren't getting the matching funds.
Also, this game seems to have been hugely mismanaged going by the fact that this was the second kickstarter campaign for the project and the first one was successful about 2 years ago. This last campaign was supposedly to finish the game. I wouldn't put much faith in a developer that needs 2 campaigns for the same project years apart. Actually, to be honest I don't trust a lot of video game kickstarters unless I'm really sure about the developer. The one video game I kickstarted is "Infinite Space 3" because I was familiar with the developer and they were able to make the previous 2 games in the series without issues. I have pity for the guys who made Dungeons but I wouldn't place them as having any kind of right to free money especially after failing to complete the game with their initial funds.
To be fair a lot of people don't take in consideration that Dungeons was to be a 3 part series, and they were entitled to the funds just as much as gridiron, had gridiron not have pulled out of FTGF this would be a whole different can of worms. You can't just say its free money when they have to actually use it to live off of and make games with, nor can you say it wouldn't have brought OUYA a profit since a lot of people did want it to get made whether they backed it or not, and that it was going to establish itself as a series would give it a lot of long term sales.

I would like to see it made. However I didn't have have confidence in them completing the game. It feels a bit like a vanity project at this point. After spending five years on the project they are now propelled by blind ambition, which is how they justified to themselves gaming the fund.

Even if the guy didn't admit where his funds came from it would have no longer been qualified after the rules changed since you need 100 backs for every 10k. He didn't have close to that.
