    JCPRuckus is correct. It is out of Kickstarters hands (and has been for a while). The terms and conditions are there to serve as an agreement between the person(s) running the campaign and the backer. If the person running the campaign breaks those terms, you have the option of attempting legal recourse against them. However, I doubt it would amount to much and a person would be much better off getting a refund from OUYA (since they are offering them) if they feel they've not lived up to their end of the bargain.

    While everything with the shipping has gone far from smoothly, it's not like OUYA has been out to screw people or scam them. Delays tend to happen in both production and shipping, OUYA made some mistakes, they weren't the best a communicated what was happening, but in the end they were trying to get everyone their OUYAs as fast as they can. Sure it sucks some people haven't gotten theirs yet, and yes OUYA did make a promise that they were unable to keep, but in the end everyone will get their OUYA eventually. If that person feels the delays have ruined the device for them or lost faith in the company, they should contact support@ouya.tv about getting a refund. I wish there were a better answer, but I think that's all there is to the situation at this point.

    There is a difference between a "fan" or "supporter" and a "fanboy". Just as there is a difference between "someone with a legitimate complaint and well reasoned arguments" and a "troll".

    No one here is blindly loyal to OUYA (a.k.a., a fanboy), but no one is particularly interested in listening to the same 3 or 4 complaints being rehashed over and over, or in watching people pick apart statements by OUYA so that they can claim that OUYA are a bunch of lying liars who lie. Most people come here because they are excited about OUYA. If half the threads are called "F--- OUYA and the horse it rode in on", why would they ever come back?

    If someone just found out about OUYA and came here to help decide if they were going to buy it or not and seen 200 positive threads and 4 negative threads that were actually a bunch of different people having problems merged together then what do you think people are going to think?

    How about when they buy the OUYA and then have a problem and are stuck with a broken console for months?

    If you're not a fanboy site then you do need to accurately portray what is happening in real life. A lot of the people who come here with problems get talked down to and ran off. But they are still OUYA supporters and I would say that through my time here with the post that I have actually seen that around half the people that own the OUYA are not satisfied. Yet we want to have near 100% positive post. Too funny

    Welcome back fireballs... I don't feel the need to answer that as you know full well the intent in my statement...

    Okay how many of those with a negative opinion or a negative experience of OUYA are more concerned with the negative aspects of OUYA being snowed over in this forum is the biggest concern here, and how many are more concerned with just being allowed to shout your opinions out loud as often and as loud as possible.

    Because if you're willing to actually present your negative experiences in a intelligent and tame manner... I'm trying to petition for you to have an equal visibility without restraints. But this has seriously got to calm down because, despite your [valid] concerns. Alot of you are coming across in a negative light yourselves. Not trying to insult you guys, but honestly you're in alternating offensive/defensive mode and it's just coming across belligerent.

    As long as the argument is valid then I can get behind this one-hundred percent. If not, then they can go ahead and go to some other forum and complain.

    This OUYA preorder thing has taught me something and I didn't even preorder one. I will never in my life preorder anything online, because when you do and something like this happens the customer can do nothing about it except complain to the company and ask for a refund and the company never gets back to you. From now on whenever I preorder something like this its going to be from retail. That way if something like this does happen I can get my money back from the retailer. Its probably the safest way to deal with things like this.

    Repeated situations have told me to never order anything online. It always gets either lost or stolen and for a few years now, I've been quitting cold-turkey.
