The text in the opening post suggests developers can still decide if they want their games to be part of Ouya Everywhere for a particular platform. However, I cannot find this in the actual agreement that developers are asked to sign.
Edit: I have submitted a question to Ouya support asking if it can be added to the agreement that participation in Ouya Everywhere is still an option, not a requirement. (In understand Ouya still sees it as an option, but it would be nice for the agreement to reflect that.)

On the support page ("Recent changes to the Marketplace Agreement 2015", January 29) it says: "It's still up to you if you want to make your game available in a given territory or distribution platform though, just like today." The fun aspect of Ouya to me at least is how simple it is, developing for one device. If it is required that a game is translated to Chinese and tested on one or more other devices that I don't want the game to appear on in the first place then that makes it less attractive. So I am curious what they will reply to my e-mail or what info there will be.

Meaning you don't have to if you don't want to. If you want it in chinese region, make sure it supports chinese language. If you want it on another device, make sure it works on said device.
Yes I know, but that is on the support page. In the agreement itself it does not say that. To be clear I am not against OE or against games in China :), it's just that there seems to be a line missing from the agreement. (Or it is not missing but then the support page is wrong.)
There's section 5.f:
Geographic Filtering. We may provide you with an ability to designate regions or countries where you do not want us to offer your Games. We will use reasonable efforts to implement measures intended to identify an end user’s country and to not offer your Games for sale to gamers from any countries you designate. We may rely on our determination of an end user’s country for all purposes under this Agreement.
